Terms and conditions of purchase

1. Contracting parties. When you purchase any items through any of the Sites you will be contracting with Red-i Solutions Limited t/a Trust the DJ, a limited liability company incorporated in England and Wales under company number 6171455. TrusttheDJ.com is referred to in these terms and conditions as "we" "us" or "our". Our registered office is at Studio 131, Rosden House, 372 Old Street, London, EC1V 9AU. TTDJ's trading address is Studio 131, Rosden House, 372 Old Street, London, EC1V 9AU, United Kingdom.

2. Availability. Where possible we will endeavour to source all products or merchandise ordered from our suppliers. If an item is unavailable for whatever reason, we will contact you and let you know when we anticipate that the item will become available and ask you whether you still wish us to fulfil your order in part or whether you would like us to cancel your order (in which case we will refund any monies paid by you). You will also be able to split any order on the Sites. TTDJ sell tickets on behalf of promoters, agents, artists and venues and TTDJ do not determine ticket prices or, where applicable, relevant seating allocation. Occasionally customers will be restricted to the purchase of a limited number of tickets and these restrictions will be set out on the Sites during the purchase process.

3. Description. We try to ensure that all of the items shown on the Sites are accurately described however slight variations in colour should be expected in respect of clothing and other merchandise.

4. Provision of information. You agree to provide true, accurate and complete information about yourself whenever you register or order any items from us. When you order any items from us you will need to provide us with your name, address, e-mail address and credit card details. Whenever you make a purchase an account will be set up for you. You can provide more information about yourself to allow us to better serve you with products and content. We will use these details in accordance with our privacy policy. 5. Security Policy. TTDJ uses the latest 128bit encryption technology to keep your credit card and personal information safe. When making a purchase at TTDJ, you are protected using SSL encryption - the Internet standard for secure transactions. If you prefer, you can telephone or fax your order and credit card information to us. Your order information, order history and order tracking are further protected by the combination of your username and password. If you forget your password we will verify your identity and send your password details to the default email account specified in your personal profile.

6. Pricing. Although prices can be displayed in a number of currencies using our currency converters, the final payment will be based on the price in pounds sterling and converted at the prevailing exchange rate. Prices charged may differ slightly to the price quoted due to fluctuating exchange rates over time and differing exchange rate quote sources. Prices quoted include any VAT that may be due as a result of any order that you make, but are exclusive of delivery charges. In the event that you order an item and the price published on the Site was incorrect for any reason we will contact you to let you know the correct price and ask you whether you still wish us to fulfil your order at this price. TTDJ sell tickets on behalf of promoters, agents, artists and venues and TTDJ do not determine pricing. Furthermore, TTDJ may charge or may be obliged to charge a per ticket convenience charge and/or a per order processing fee and/or a booking fee and/or a handling fee which shall each be non-refundable. Wherever such charges and fees are charged by TTDJ, we will provide a breakdown of the overall purchase price to indicate these charges and fees separately from the ticket price.

7. Payment. You may pay for your order in any of the following ways:

(a) on-line by using most major credit and debit cards;

(b) by faxing an order form, including contact details and full credit card payment details to our Call Centre on +44 (0)20 8960 9660; or

(c) by post by sending full details of the items you wish to order and a cheque or other payment method that can be drawn upon by UK banks. You will need to contact us for shipping costs.

8. Delivery. We deliver to all countries listed on the web sites delivery information page(s). We will deliver your order to the address you provide to us when completing the purchasing process so please ensure that this address is correct. To reduce credit card fraud, your first order and subsequent orders made using a new credit card within 28 days will only be delivered to the credit card billing address. We will endeavour to dispatch your order within 4 business days and will notify you if your order will be delayed for a material time for any reason. In certain cases, especially where the order involves specialist or rare items, we rely on certain companies to source product for orders and the delivery of your order may be affected by their delay, howsoever caused. In all cases your order will be delivered within 30 days unless we notify you otherwise. You will be notified of any delivery charges when you place your order. 9. Right to cancel, Returns and Refunds. Save in respect of orders for tickets you have the right to cancel your order within 14 days of delivery. If you wish to cancel your order within this period please complete the Return Form which will be provided to you with your order. If you have lost your Return Form please call our Call Centre who will be able to assist you. Please note that this right does not apply to goods made to your specifications or which have been clearly personalised, or to audio or video recordings which you have taken out of any sealed package in which they were delivered, or for the avoidance of doubt, to digital purchases once you have downloaded them.

You can cancel orders prior to despatch using the online order tracking system, which is located in 'Your Account' on the TTDJ web site. In the event that you cancel an order or any part of an order before the items have been despatched to you, we will give you a full refund of any monies paid within ten working days of receipt of notification from you that you wish to cancel your order. Save in respect of an order for tickets which will not be refundable following despatch of the tickets, in the event that you cancel an order after the items have been despatched to you, we will refund the value of the items to you within ten working days of you having returned the items to us in an unused and re-saleable condition. Refunds will be made by way of a credit to the credit card/debit card account used to make your order.

Before purchasing tickets please carefully review the event, date, venue and (where applicable) your seat selection as the policies set forth by TTDJ's clients in respect of the sale of tickets prohibit TTDJ offering exchanges or refunds once a ticket has been purchased. TTDJ is not able to offer a replacement or refund in cases where tickets are lost, stolen damaged or destroyed.

Occasionally events will be cancelled or postponed by the promoter, agent, venue or artist. Wherever this occurs TTDJ will use its reasonable endeavours to ensure that you receive either a refund of the ticket price or a replacement ticket for a rescheduled date, but TTDJ will not be able to refund any associated charges or fees paid by customers. If an event is cancelled please contact us for information regarding the procedure for obtaining a refund or replacement ticket.

If any items delivered to you are defective, they can be returned to us providing that the items have been opened and are defective. We will endeavour to replace the items and will not charge you for the delivery costs of the replacement or we will refund the reasonable costs of returning the defective items to us. If an item is sent to you in error, please return it to us and we will endeavour to send the correct items to you. In such cases we will not charge you for the delivery costs of the replacement items or we can refund the delivery costs associated with the original delivery.

Please note that your right to return items to us in accordance with these terms and conditions is in addition to any other statutory rights you may have.

Code of Conduct

10. Code of Conduct. Not all information, data, text, software, music, sound, photographs, graphics, video, messages, advice, statements or other materials ("Content"), publicly posted or privately transmitted via the Sites is the sole responsibility of TTDJ. If you choose to publicly post Content on, for example, a message board, you, and not TTDJ, are entirely responsible for all Content that you upload, post, email or otherwise transmit via the Sites.

You hereby grant TTDJ the right to use the content of any email sent to TTDJ DJs using an email address with the domain '@trustthedj.com' on the Sites at TTDJ's sole discretion. TTDJ reserves the right to post responses to email from DJs with the original message or an edited version.

TTDJ does not control all of the Content posted on the Sites and, as such, does not guarantee the accuracy, integrity or quality of such Content. You understand that by using the Sites, you may be exposed to Content that is offensive, indecent or objectionable. Under no circumstances will TTDJ be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed or otherwise transmitted via the Sites.

You agree not to use the Service to:

(a) upload, post, publish, distribute, disseminate or otherwise transmit any Content (hereinafter "post") that is unlawful, tortuous, defamatory, harmful or invasive of another's privacy, or otherwise objectionable, including but not limited to material that promotes or provides instructional information about illegal activities or promotes physical harm or injury against any group or individual;

(b) upload, post or otherwise transmit any Content that you do not have a right to transmit under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under non disclosure agreements);

(c) upload, post or otherwise transmit any Content that infringes any patent, trademark, trade secret, copyright or other proprietary and intellectual property rights of any party;

(d) harm minors in any way;

(e) impersonate any person or entity, including, but not limited to, a TTDJ official, user of the Sites, message board administrator, guide or host, or falsely state or otherwise misrepresent your affiliation with a person or entity;

(f) forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted through the Sites;

(g) upload, post or otherwise transmit any unsolicited or unauthorised advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation, except in those areas of the Sites, if any, that are designated for such purpose;

(h) upload, post or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;

(i) disrupt the normal flow of dialogue, cause a screen to "scroll" faster than other users of the Sites are able to type, or otherwise act in a manner that negatively affects other users' ability to engage in real time exchanges;

(j) interfere with or disrupt the Sites or servers or networks connected to the Service, or infringe any requirements, procedures, policies or regulations of networks connected to the Sites, or interfering with another user's use and enjoyment of the Sites, including but not limited to (a) transmitting any material that contains viruses, trojan horses, worms, time bombs, or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information, or (b) attempting to gain unauthorised access to the Sites, other's accounts on the Sites, or private mailing lists on the Sites through password mining or any other means;

(k) intentionally or unintentionally violate any applicable local, state, national or international law, including, but not limited to, UK legislation such as the Data Protection Act, Consumer Protection Act, or Financial Services Act, or any amendments or replacements of such acts;

(l) defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others;

(m) collect, store, or distribute personal data about other users without their consent;

(n) promote or provide instructional information about illegal activities, promote physical harm or injury against any group or individual, or promote any act of cruelty to animals; or

(o) not to advertise or solicit other any other user of the Sites to buy or sell goods or services through the Service.

You acknowledge that TTDJ does not pre-screen Content, but that TTDJ and its designees shall have the right (but not the obligation) in their sole discretion to refuse, amend, remove or move any Content that is available via the Sites. Without limiting the foregoing, TTDJ and its designees shall have the right to remove any Content that violates these terms and conditions or which is otherwise in our opinion, objectionable. You agree that you must evaluate, and bear all risks associated with, the use of any Content, including any reliance on the accuracy, completeness, or usefulness of such Content. In this regard, you acknowledge that you may not rely on any Content created by TTDJ or submitted to TTDJ, including without limitation information in TTDJ discussion forums, bulletin boards, chat areas, news groups message boards, forums, and in all other areas of the Sites. TTDJ will have no liability or responsibility for performance or non-performance of such activities. TTDJ reserves the right to terminate or restrict your use of any or all of the Sites at any time without notice for any reason whatsoever.

You acknowledge and agree that TTDJ may preserve Content and may also disclose Content if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to:

(a) comply with any applicable law;

(b) enforce the Terms;

(c) respond to claims that any Content violates the rights of third-parties; or

(d) protect the rights, property, or personal safety of TTDJ, its users and the public.

You understand that the technical processing and transmission of the Sites, including your Content, may involve:

(a) transmissions over various networks; and

(b) changes to conform and adapt to technical requirements of connecting networks or devices.

General terms and conditions

11. Provision of general information. If you choose to register your details in the "Record Box", it would assist us greatly if you keep this information accurate, complete and up to date. We will use these details in accordance with our privacy policy.

12. Proprietary Rights and Licences. All text, software, music, sound, photographs, graphics, video, page layouts, design and other material that is contained on the Sites is protected by our or third party copyrights, trade marks, service marks, patents or other proprietary rights and laws.

You are not permitted, except where expressly authorised to do so, to change, copy, store, publish, rent, licence, sell or distribute in any way any of these intellectual property rights.

We have applied to register "TrusttheDJ" and our logo device(s) as trademarks. You agree not to display or use it in any manner without our prior written consent.

13. External Links. We may provide links to other websites or resources from time to time. These links are provided for your convenience. We do not endorse the contents of those websites, are not responsible for the availability of these websites and will not be liable in any way for any loss or damage which you may suffer by using those websites. If you decide to access linked third party websites you do so at your own risk.

14. Framing. Framing of the Sites is permitted only with the prior written consent of TTDJ. TTDJ may require specific measures are to be taken to avoid user or consumer confusion. TTDJ reserves the right to withhold consent for any reason and any failure to monitor or control each instance of the framing of the Sites shall not be considered a waiver of any of TTDJ's rights. Any framing of the Sites shall not imply endorsement by TTDJ or sponsorship of TTDJ or its affiliates.

15. Disclaimer of Warranties. You agree that:

15.1 your use of the Sites is at your sole risk. The Sites are provided on an "as is" and "as available" basis and we shall not be liable to you for your use of or your inability to use any of the Sites;

15.2 no advice or information, whether oral or written, obtained by you via the Sites will create any warranty not expressly stated in these terms and conditions; and

15.3 all warranties in respect of the Sites, the items supplied by us and any other services that we may provide through the Sites from time to time are excluded to the fullest extent permitted by law. This does not prejudice your statutory rights.

16. Amendment of Sites and Services. We reserve the right to amend the Sites and the items and services that we offer to you via the Sites without notice to you from time to time. We will, however, endeavour to let you know of any material changes via our home page or the home page of the relevant DJ Site.

17. General. These terms and conditions constitute the entire agreement between us in respect of the use of the Sites and the items and services offered via the Sites. We may vary these terms and conditions from time to time without notice and you should therefore check them each time you intend to make a new purchase.

If any of these terms and conditions are found to be invalid this shall not affect the validity of the remaining provisions which shall remain fully enforceable. No waiver by us of any term shall be deemed to be continuing or shall be deemed to be a waiver of any other term.

These terms and conditions will be interpreted and construed in accordance with the laws of England and Wales and will be subject to the non-exclusive jurisdiction of the English Courts.
